As society continues to become more digital and technology permeates every aspect of our lives, authorities are struggling with how they can adapt. The Covid Mask mandates is one such example that aims to provide a framework for online authority in the new age.

The Biden administration’s actions this week should dispel any impression that mask requirements still have anything to do with public health. Judge Kathryn Kimball Mizelle vacated the Centers for Disease Control and Prevention’s rule mandating masks on flights, airports, and other modes of transportation and hubs on Monday. According to the Journal, the agency stated on Tuesday that it would appeal the decision “only if the CDC judged such an order essential.” The CDC confirmed this on Wednesday, and the agency filed an appeal notice.
As a matter of law, this manoeuvre was absurd. The Public Health Services Act allows the CDC to require certain sorts of steps that are “‘in [its] opinion essential’ to prevent the spread of infectious illness,” according to Judge Mizelle’s decision. The mask requirement was described by the administration as a “sanitation” measure. She said it was invalid since it did not meet the definition of “sanitation” (or any other sort of measure approved under the legislation).
On appeal, the department’s attorneys will argue that she misinterpreted the language and that the mask requirement qualifies as a sanitary measure. It’s possible that a higher court will agree. However, the CDC has previously decided that the mandate was required for public health—a legal requirement for all such rules—at least until May 3, when the most recent extension expired. It was solely a political choice whether or not to restate that determination on Wednesday.
So, what’s the purpose of filing an appeal? Former Food and Drug Administration Commissioner Scott Gottlieb (and contributor to these pages) got it right. He told CNBC Wednesday morning, “The concerns here from this judgement aren’t the immediate effect on public health.” “The dangers are longer-term, and this might diminish the CDC’s authority.”
Mask demands became a question of imposing power on those with lesser status around a year ago, rather than protecting public health. That explains why, despite the fact that young people are not at danger from Covid, they have remained significantly longer at schools and colleges, which have the power to manage student behavior, than in most adult contexts. It explains why politicians often disobeyed their own mask laws in public. It explains why the CDC determined that only unvaccinated persons needed to maintain wearing masks during the short Covid spring of 2021.
It explains why, even when the CDC switched course in July and urged everyone to wear masks, big merchants and service organizations required personnel to wear masks but not consumers. With one significant exception: masks for everyone were still in high demand at several high-end stores. Those establishments offer status and hence have a vested interest in lowering the bar for potential clients. Some of them imposed similar restrictions on admittance based on social distance.
Medical offices are the only kind of business where wearing a mask is still required. Although the health argument is certainly stronger there than elsewhere, it presents an irony. A surgical mask used to be a sign of a doctor’s authority. It now symbolizes the patient’s consent.
